THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.35919 of 2016 ORDER:

This writ petition under Article 226 of Constitution of India is filed seeking a direction to the 2nd respondent to proceed with the investigation in Crime No.71 of 2015 and take action against the accused therein.

Heard and perused the material available on record. The grievance of the petitioner is that basing on a complaint given by the 3rd respondent, the 2nd respondent registered a case in Crime No.71 of 2015, dated 16.06.2015, for the offence under Sections 66, 66-C & 66-D of I.T. Amendment Act, 2008, and Sections 465, 367 & 471 IPC. The petitioner has been implicated in the said crime basing on the confessional statement of A-1 and the allegation against the petitioner is that he destroyed the password of Arjun Granite firm and arranged a new password to A-1. It is the case of the petitioner that the petitioner filed Crl.P.No.10942 of 2015, which was disposed of on 03.06.2016 with a direction to the Investigating Officer to complete the investigation within a period of three months.

Considering the grievance of the petitioner, the 2nd respondent is directed to complete the investigation in Crime No.71 of 2015, as expeditiously as possible, and file a final report, if any, either way in accordance with law.

Accordingly, the Writ Petition is disposed of. No costs. Pending Miscellaneous Petitions, if any, shall stand closed. _________________ RAJA ELANGO,J Date: 25th October, 2016.
