THE HON'BLE SRI JUSTI CE SANJAY KUMAR AND THE HON'BLE SRI JUSTI CE M.GANGA RAO I .A.No.1 OF 2018 I N WRI T PETI TI ON No.36489 OF 2012 AND WRI T PETI TI ON No.36489 OF 2012 COMMON ORDER: (per Hon'ble Sri Justice Sanjay Kumar) This writ petition was filed by the unsuccessful applicant in O.A.No.1983 of 2005 on the file of the Andhra Pradesh Administrative Tribunal, Hyderabad, aggrieved by the order dated 29.04.2010 passed therein and the subsequent order dated 07.06.2012, whereby Review M.A.No.1480 of 2010 filed by him in the said O.A. was dismissed. Consequential prayer was made to set aside the proceedings dated 15.03.2004 and declare that the date of regularization of the petitioner should be treated as 20.03.1991 instead of 23.12.1994. While so, I.A.No.
1 of 2018 was filed by the petitioner asserting that the issues arising in this writ petition are squarely covered by the decision rendered by this Court in W.P.No.36387 of 2012 and seeking consequential relief. A copy of the order dated 30.04.2018 passed by this Court in the said writ petition is placed on record. Learned Government Pleader for Services, State of Andhra Pradesh, fairly concedes that the earlier adjudication by this Court in W.P.No.36387 of 2012 would settle all issues arising for consideration in this writ petition.
In that view of the matter, for reasons alike as were stated in the order dated 30.04.2018 passed by this Court in W.P.No.36387 of 2012 and in terms thereof, the writ petition is allowed setting aside the orders dated 29.04.2010 and 07.06.2012 passed by the Tribunal in O.A.No.1983 of 2005 and Review M.A.No.1480 of 2010 in O.A.No.1983 of 2005 respectively. The date of regularization of the petitioner shall be treated
as 20.03.1991 instead of 23.12.1994. The authorities shall also restore his provisional seniority accordingly.
I.A.No.1 of is accordingly ordered.
Other pending miscellaneous petitions, if any, shall stand closed in the light of this final order. No order as to costs.
