Heard learned counsel for the petitioners and learned Standing Counsel for AP GENCO appearing for the respondents. 2.

Petitioners claimed to be working on contract basis in Rayalaseema Thermal Power Project, Ash Handling Plant Stage III. They sought for continuation of their service as contract labour in the said project.

At the time of admission of the Writ Petition, this Court, by order dated 24.08.2012, issued the following direction. "In the event the respondents undertake engagement of contract labour in the Rayalaseema Thermal Power Project Ash Handling Plant Stage III, they shall consider the petitioners for such engagement on priority basis taking into account their length of service."

As can be seen from the interim order, the Court only granted liberty to the respondents to consider the petitioners for such engagement on priority basis, if the respondents undertake engagement of contract labour.

According to learned Standing Counsel for AP GENCO., petitioners are not engaged and are not working. 6.

Having regard to the fact that the petitioners were not engaged and were not working, the cause in the Writ Petition does not survive for adjudication and the Writ Petition has become infructuous.

The Writ Petition is accordingly dismissed. There shall be no order as to costs. Pending Miscellaneous Petitions, if any, shall stand closed.
