Heard learned counsel for the parties.

The petitioner seeks a declaration that the land acquisition proceedings in respect of her land admeasuring 0-50 cents in Sy.No. 86/1 situated at Srungarayanipalem, Kirlampudi Mandal, East Godavari district have become unenforceable and lapsed for not passing of the award.

Learned Government Pleader for Land Acquisition,

on instructions, submits that an extent of Ac.4.04 cents of land in Sy.No. 86/1 situated at Shrungarayanipalem of Kirlampudi Mandal was notified under Section 4 (1) of the Land Acquisition Act (for short "the Act") on 30.9.2006 and after conducting enquiry under Section 5-A of the Act, a declaration was issued under Section 6 of the Act with regard to Ac.3.44 cents, however later an award was passed in respect of Ac.1.41 cents i.e., 0.33 cents in Sy.No. 86/1A, 0.33 cents in Sy.No. 86/1E and 0.75 cents in Sy.No. 86/1D and compensation was also paid to the awardees and the land is vested in the State. To the extent of remaining Ac.2.03 cents which includes the petitioner's land, he accepts that the land acquisition proceedings lapsed due to non-passing of the award within the statutory period and he states that no further action is being taken with regard to the remaining land notified under Section 4 (1) of the Act, dated 30.9.2006, referred to above.

In view of the categorical statement as above, the petitioner is free to enjoy the land claimed by her in accordance with law and there would not be any further impediment from the Land Acquisition Officer in enjoying the same.

The writ petition is accordingly disposed of. Miscellaneous applications, if any, shall stand closed.

There shall be no order as to costs.
