Bhagyamma W/o.K.Chandrappa, Aged about 38 yrs, Hindu, Housewife, R/o.D.No.4-2-166, DB Colony, Hindupur, Anantapur District & others .. Respondents

This Court made the following :

ORDER :

The petitioners herein are the plaintiffs in O.S.No.3 of 2013 on the file of Additional District Judge, Hindupur, Ananthapur District. The petitioners aver that they filed I.A.No.47 of 2013 seeking temporary injunction. This Revision is filed contending that the said I.A., was filed in the year 2013, and even though counter affidavit is filed by the defendants/respondents, so far no orders are passed in the I.A., and on account of delay in passing orders, grave prejudice is caused to the petitioners.

2. Learned counsel for the petitioners submits that there is no justification for

such an inordinate delay in passing the orders in I.A., moved by the petitioners.

3. Learned counsel for the respondents submits that the petitioners are not cooperating for early disposal of the I.A and no effort was made by the petitioners for its disposal. Even when the officer was on leave, the matter was considered by the in-charge Court but no effort was made by the petitioner for early disposal and there is no bonafides in filing the revision.

4. As pointed out by the learned counsel for the petitioners, the I.A.No.47 of 2013 was filed for grant of temporary injunction and even though counter is filed, the matter is not disposed of. I am not inclined to go into the rival contentions of the parties in this revision.

5 . Hence, without expressing any opinion on merits this Civil Revision Petition is disposed of observing that the court below shall consider and dispose of the I.A.No.47 of 2013, as expeditiously as possible subject to the convenience of the trial Court. There shall be no order as to costs.

6. Miscellaneous petitions, if any, pending in this Civil Revision Petition shall stand dismissed.
