Heard the learned counsel for the petitioner Sri C.Siva Sankar and the learned Assistant Solicitor General Sri B.Narayana Reddy for the union of India for the respondents.

At the hearing, it is submitted by the learned counsel for the petitioner that in identical set of circumstances the District Collector, Karimnagar, vide his proceedings No.C6/903/2009, dated 22.02.2009, after re-verification, recommended the case of one Sri Gadda Komuraiah, S/o. Balaiah, R/o. Koppur Village of Bheemdevarapalli Mandal. It is further submitted that similar recommendations were made in cases of others also. It is brought to the notice of this Court by the learned counsel for the petitioner so also the learned Assistant Solicitor General, Sri B. Narayana Reddy, appearing for the respondents that in similar circumstances this Court disposed of W.P.No.12376 of 2011 by way of an order, dated 22.12.2016, and a copy of the said order is placed on record. The operative portion of the said order reads as under:
"On the other hand, learned counsel representing the Central Government would submit that the enquiry has been conducted but order could not be passed because of the pendency of the writ petition before this Court. In that view of the matter, without going into the merits of the case and having regard to the submissions made, the writ petition is disposed of directing the respondent authorities to pass final orders in accordance with law, if not already passed. Till such time, the respondents shall pay the pension to the petitioner, if he is being paid during the pendency of the writ petition. No order as to costs. Consequently, miscellaneous petitions, if any, pending in this writ petition shall stand closed."

Following the said order and for the reasons stated therein, this writ petition also stands disposed of in terms thereof. The respondents herein while dealing with the issues may consider the recommendations of the District Collector, Karimnagar, in identical situation vide proceedings No.C6/903/2009, dated 22.02.2009.
