This appeal, under Clause 15 of the Letters Patent, is preferred against the order passed by the learned Single Judge in W.P. No. 25799 of 2013 dated 4.10.2013. The appellant herein, an Anganwadi worker, filed W.P.No. 25799 of 2013 to declare the action of respondent Nos. 1 to 5, in inviting applications for recruitment to the post of Grade-II Supervisors fixing 45 years as the maximum age, as illegal and arbitrary.
Before the learned Single Judge, the learned counsel for the petitioner, fairly stated that this issue was squarely covered by the judgment of the Division Bench in W.P. No. 21783 of 2013 and batch dated 2.8.2013 which had confirmed fixation of the maximum age at 45 years. The writ petition was, therefore, dismissed. Aggrieved thereby, the present appeal. When the appeal came up for admission on 27.1.2014 the Division Bench, while admitting the appeal, dismissed WAMP No.3545 of 2013 having regard to the fact that the examination, scheduled to be held on 27.10.2013, was already over; and the WAMP had become infructuous.
As the learned Single Judge has merely followed the order of the Division Bench, in W.P. No. 21783 of 2013 and batch dated 2.8.2013, which had confirmed fixation of the maximum age at 45 years, we see no reason to take a different view.
Following the said judgment, and in terms thereof, this appeal is also dismissed. Miscellaneous Petitions pending, if any, shall also stand dismissed.
