ORDER

This writ petition is filed seeking the following relief: "...to issue writ, order or direction more in the nature Writ of Mandamus declaring the impugned action of the 2nd respondent in not allowing the petitioners for the Certificates Verification though they have required qualifications-studied and completed successfully in 3 year Diploma in Plastic Mould Technology (DPMT) from Central Institute of Chemicals and Petro Chemicals, Ministry of Chemicals and Fertilizers, Government of India-approved by AICTE (All Indian Council for Technical Education) as per the Notification No.RC.No.

88/Rect/ Admin-1/2018, dated 31-5-2018, and as a result the petitioners herein grave injustice as the petitioners herein are going to lose the opportunity of getting selected after successful completion of all the phases of the recruitment such as Preliminary Written Test (PWT), Physical Measurement Test (PMT), Physical Efficiency Test (PET) and a Final Written Examination (FEW) for the Direct recruitment of Stipendiary Cadet Trainee (SCT) Police Constable (Civil), SCT PC (AR), SCT PC (SAR CPL) SCT PC (TSSP), Firemen and Warders Notification No.RC.No.88/Rect/Admin-1/2018, Dated 31.5.

2018 as illegal, arbitrary, discriminatory and violative of Articles 14, 16, 19 (g) and 21 of the Constitution of India and consequently direct the 2nd respondent to consider the petitioners for the Certificates Verification as they are qualified as per Notification No.RC.No.88/Rect/Admin-1/2018, dated 31.5.2018 and as per G.O.Ms.No.112, Higher Education (TE-I) Dept, dated 27.10.

petitioners herein to participate in the further selection process in the interest of justice and to pass such other order or orders as this Hon'ble Court may deem fit, just and proper in the circumstances of the case." Heard learned counsel on either side.

The grievance of the petitioners is that though they have acquired Diploma in Plastic Mould Technology from Central Institute of Chemicals & Petro-Chemicals, the respondents are not considering their cases for certificate verification as the said qualification is not equivalent to Intermediate. Learned Standing Counsel appearing for the 4th respondent contends that the certificates awarded by the 4th respondent are to be treated as equivalent to Intermediate. Learned Standing Counsel appearing for the 2nd respondent contends that the respondents are considering the qualifications possessed by the petitioners as equivalent to Intermediate and the cases of the petitioners would be considered for certificate verification.

Having considered the rival submissions made by the learned counsel on either side, this Writ Petition can be disposed of directing respondent No.2 to consider the qualifications acquired by the petitioners as equivalent to Intermediate, permit them to participate in the selection process, and if they are qualified, appoint them in the posts to which they are entitled.

Accordingly, the Writ Petition is disposed of. No costs. Miscellaneous petitions, pending, if any shall stand closed.
