In the present writ petition, petitioner is praying for extension of benefits under G.O.Ms.No.94, Transport, Roads & Buildings (R.I) Department, dated 16.04.2008 regarding price adjustment for all on going and future works.

In the instant case, as evident from the information available, petitioner herein entered into an agreement with the third respondent on 06.01.2005 for execution of the work for construction of District Jail at Ampolu village, Srikakulam District. It is also evident that the petitioner herein completed his work within time i.e., by 25.12.2007. G.O.Ms.No.94, Transport, Roads & Buildings (R.I) Department came into being with effect from 16.04.2008. Therefore, the benefits given under the said G.O. cannot be extended to the petitioner as he had completed the work much prior to the said date. Therefore, this Court does not find any merit in the writ petition.

Accordingly, the writ petition is dismissed. As a sequel, the miscellaneous petitions, if any, shall stand closed. There shall be no order as to costs.
