THE HON'BLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION No.8634 of 2017 ORDER :

Petitioner is presently working as Mate in Pittalagudem village. He claims that he belong to scheduled caste community. Petitioner is now aspiring for appointment as Field Assistant and according to him, he has secured more marks as per the evaluation. But erroneously his marks are scaled down to 92 and he is sought to be ignored and another candidate is sought to be appointed. Ventilating his grievance that erroneously the marks secured by him are wrongly reflected and lesser number of marks are shown against him, than what he is entitled to, he raised a complaint on 20.02.2017. Alleging inaction on his complaint and seeking to appoint somebody else, this writ petition is filed. 2.

Learned Special Standing counsel submits that the assessment made by the respective unit heads are forwarded to the Project Director who is the competent authority and on evaluation of the assessments made, he would take decision to appoint the persons recommended by the unit heads and the issue is at that stage.

Since petitioner raised grievance of ignoring his claim by assessing wrong marks, I deem it proper to direct the Project Director, District Rural Development Agency (3rd respondent) to examine the complaint of the petitioner made on 16.12.2016 followed by 20.02.2017, before finalising the selections, more particularly the selection and appointment of Field Assistants in

Pittalagudem village, if there is need to re-assign eligibility and in the process, if any person who is now shown as senior and not meritorious, would be effected, he should also be put on notice and be given an opportunity of hearing, before taking a decision affecting such person.

With the above directions, the writ petition is disposed of. There shall be no order as to costs.

Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
