HON'BLE SRI JUSTICE S.V. BHATT W.P.No.6458 of 2015 ORDER:
The petitioners pray for Mandamus declaring the action of respondents in acquiring petitioners' property covered by Dr.No.18-1544/1/A at Kandikal Gate, Hyderabad for expansion of existing drainage canal without recourse to law or paying compensation as illegal and unconstitutional.
Learned standing counsel Sri C.Damodhar Reddy, on instructions, submits that the writ petition is filed on mere apprehension, for as on date, the Engineering Department has taken measurement of plan for acquisition and in the event of the approval accepted by the competent authority, the respondents will follow the procedure stipulated by law and acquire the property of the petitioners.
The statement of learned standing counsel is placed on record. The writ petition is disposed of accordingly. No order as to costs.
Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
