HCJ & AAR, J C.C. No.907 of 2019 Dt: 05.11.2019 ORDER: (per the Hon'ble the Chief Justice Sri Raghvendra Singh Chauhan) The present contempt petition has been filed ostensibly on the ground that the direction issued by a learned Coordinate Bench on 19.09.2018, in W.P.No.10177 of 2015, has not been complied with.

The learned Coordinate Bench had directed as under: As there seems to be a change in the mind set of the authorities with regard to the aforestated qualifications being sufficient for the purpose of appointment of Cluster Resources Persons, as is brought out by the fact that several such persons have been appointed in Ranga Reddy District, the writ petition is disposed of directing the authorities to consider the representation dated 29.10.2015 made by the petitioner in the light of the like cases cited by him. This exercise shall be completed expeditiously, and in any event not later than eight weeks from the date of receipt of a copy of this order.

The learned counsel for the alleged contemnors submits that in fact the issue with regard to the filling up of the post of Cluster Resource Persons at School Complexes with erstwhile Non-Formal Education Instructors/Supervisions was considered. Although certain people were appointed, by order dated 25.10.2019, the services of those persons have been discontinued w.e.f. 26.10.2019. Moreover, by order dated 03.09.2019, the petitioner's representation was duly considered by the alleged contemnors and was rejected. Therefore, according to the learned counsel for the alleged contemnors, in case the petitioner has any grievance against the order dated 03.09.2019, a fresh cause of action has arisen. But, nonetheless, the order passed by the learned

HCJ & AAR, J C.C. No.907 of 2019 Dt: 05.11.2019 Coordinate Bench has been duly complied with by the alleged contemnors.

On the other hand, the learned counsel for the petitioner submits that the petitioner is dissatisfied with the order dated 03.09.2019. Hence, the contempt continues to be committed by the alleged contemnors.

Heard the learned counsel for the parties, and perused the order dated 03.09.2019.

As recorded above, the learned Coordinate Bench had merely directed the alleged contemnors "to consider the representation filed by the petitioner." By order dated 03.09.2019, the petitioner's representation has been duly considered, and rejected. Therefore, in case the petitioner is aggrieved by the order dated 03.09.2019, he has ample legal remedies available to him. However, no contempt is made out, as the direction issued by the learned Coordinate Bench has been duly complied with.

For the reasons stated above, this Court does not find any merit in the present petition. It is, hereby, dismissed. As a sequel, miscellaneous petitions, pending if any, shall also stand dismissed.
