THE HON'BLE SRI JUSTICE A.V. SESHA SAI WRIT PETITION No.15275 of 2016 ORDER:

This writ petition is filed under Article 226 of the Constitution of India seeking the following relief:

"to issue writ of Mandamus to declare the action of the respondents in not considering the case of petitioner as per G.O.Ms.No.661 G.A.(Ser-A), dated 23-10-2008 as illegal, arbitrary and violative of Articles 14 and 16 of the Constitution of India and consequently direct the respondents to appoint the petitioner in service." Heard Sri T.V.P. Prabhakar, learned counsel for the petitioner, Sri T. Amarnath Goud, learned counsel for respondent No.1, learned Government Pleader for Cooperation for respondent No.2, learned Government Pleader for Panchayat Raj for respondent Nos.3 and 4 and learned Government Pleader for General Administration for respondent No.5.

When the matter is taken up, it is submitted by learned counsel for the petitioner that for redressal of the grievance of the petitioner, the petitioner herein submitted a representation on 0106-2015 to the 3rd respondent herein and no orders have been passed on the said representation so far. A request is made by the learned counsel for the petitioner to direct the 3rd respondent to pass appropriate orders on the representation, dated 01-06-2015, in accordance with law, by fixing some timeframe. The said request is not opposed by learned counsel for respondents and submitted that the said representation would be considered, in accordance with law.

For the aforesaid reasons, the writ petition is disposed of, without expressing any opinion on the merits and demerits of the matter and entitlement of the petitioner, directing the 3rd respondent to consider and pass appropriate orders on the representation, dated 01-06-2015 said to have been submitted by the petitioner herein, in accordance with law, within a period of three (3) months from the date of receipt of a copy of this order. Miscellaneous Petitions pending, if any, shall stand closed. There shall be no order as to costs.
