THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM CONTEMPT CASE No. 908 of 2019 ORDER:

This Contempt Case is filed alleging non-compliance of the order dated 26.04.2019 passed by this Court in Writ Petition No.9105 of 2019.

By the aforesaid order, respondent No.1 herein, who is respondent No.2 in the writ petition, was directed to file an affidavit before the Court setting out the action taken with respect to the alleged illegal constructions made by respondent Nos.5 and 6 in the writ petition apart from explaining as to why this Court shall not direct initiation of prosecution against the authorities for dereliction of duties.

There is no averment in the affidavit filed in support of the Contempt Case that respondent No.1 had not complied with the order of this Court by not filing an affidavit in the writ petition. Though the learned counsel for the petitioner submits that no action was taken by the respondent authorities against respondent Nos.5 and 6 in the writ petition, a close scrutiny of the order dated 26.04.2019 indicates that there is no direction to the respondent authorities to take action as such in the matter.

CKR, J C.C.No.908 of 2019 In those circumstances, the Contempt Case is closed, however, in the event of the order of this Court is not complied with by the respondent authorities in its strict sense, the petitioner is at liberty to file a fresh contempt case against them. _________________________ CHALLA KODANDA RAM, J 16th JULY, 2019.
