This writ petition was filed seeking a direction to the Appellate Authority for Industrial and Financial Re-construction, New Delhi, the 2nd respondent, to pass orders upon the application dated 20.04.2005 filed by the petitioner company for release of Rs.100.00 lakhs along with interest to meet its

liabilities.

2. By order dated 03.05.2005, this Court granted an interim direction as prayed for. The prayer in this regard was to direct the Appellate Authority for Industrial and Financial Re-Construction, New Delhi, to consider and pass appropriate orders on the application dated 20.04.2005 filed by the petitioner company on the next date of hearing, i.e., 09.05.2005, in accordance with law. No counteraffidavit has been filed by the respondents till date.

3. As the interim order granted by this Court nearly a decade ago, practically had the effect of allowing the writ petition and as there is no indication that the said interim order has not been complied with, no further orders are required to be passed in this writ petition.

4. The interim order is therefore made absolute and the writ petition is closed. Pending miscellaneous petitions, if any, shall also stand closed. No order as to costs.
