HON'BLE SRI JUSTICE U.DURGA PRASAD RAO CRIMINAL PETITION No.4205 of 2018 ORDER:

This petition is filed under Section 482 Cr.P.C by the petitioners/A1 to A3 seeking to quash the proceedings against them in Crime No.79 of 2018 on the file of Pedakakani PS, Guntur Urban, registered for the offences under Sections 468 & 420 r/w 34 IPC. 2) Learned Additional Public Prosecutor would submit that the investigation is in the nascent stage.

3) Having regard to the nature of allegations, this Court is of the considered opinion that the investigation shall continue. However, having regard to the nature of accusation made under Sections 468 & 420 IPC, the Investigating Officer shall strictly follow the guidelines rendered by the Hon'ble Apex Court in the decision of Arnesh Kumar v. State of Bihar1 and also the procedure contemplated under Section 41-A Cr.P.C. towards the petitioners during the course of investigation. The petitioners in their turn shall cooperate with the Investigating Agency for smooth completion of investigation.
