SHANKAR NARAYANA Contempt Case No.969 of 2018 ORDER : (Per the Hon'ble The Acting Chief Justice Ramesh Ranganathan) This Contempt Case is filed alleging wilful and deliberate violation of the order passed by us in W.P.M.P.No.45452 of 2016 in W.P.No.36900 of 2016 dated 04.11.2016 wherein we had observed that, while we did not see any reason to interdict the election scheduled to be held on 05.11.2016, the result of the election shall be subject to further orders in the W.P.M.P.

The submission of Sri G.U.R.C.Prasad, learned counsel for the petitioner, is that this order disabled the respondents from announcing the election results and, since they had announced the election results, their action is in wilful and deliberate violation of the aforesaid order passed by this Court. We must express our inability to agree. All that we had observed, while making it clear that we did not see any reason to interdict the election scheduled to be held on 05.11.2016, was that the result of the election would be subject to further orders in the W.P.M.P. The said order did not disable the respondents from declaring the results of the election. All that the respondents were made aware of was that the election results, so declared by them, would be subject to the result of the W.P.M.P. Admittedly no order has, thereafter, been passed in the W.P.M.P. We are satisfied that the declaration of results by the respondents does not amount to violation of the order passed by us in W.P.M.P.No.45452 of 2016 in W.P.No.36900 of 2016 dated 04.11.2016, much less wilfully and deliberately.

The Contempt Case, as filed, is wholly misconceived and is, accordingly, dismissed. Miscellaneous Petitions pending, if any, shall also stand dismissed.
