THE HONOURABLE SRI JUSTICE A. RAJASHEKER REDDY WRIT PETITION No.14366 of 2019 ORDER:

The case of the petitioner is that he has been falsely implicated in three criminal cases registered by the C.B.I. police under the provisions of Prevention of Money Laundering Act. The 3rd respondent issued summons to the petitioner to appear on 28.06.2019 along with documents, as such, he appeared and produced the documents. The 3rd respondent also recorded his statement. The petitioner submits that he is cooperating with the enquiry and investigation. When the petitioner appeared on 08.07.2019 in pursuance to the summons issued by the 3rd respondent, he was asked to appear on 19.07.2019, but due to 'Sarcoidosis', he requested the 3rd respondent to exempt for further appearance, but the said request was refused. As such, on the same day i.e., on 08.07.2019, the petitioner approached the 2nd respondent and submitted a representation requesting two weeks time. But, the respondents are asked to attend on 19.07.2019. Aggrieved by the same, present writ petition is filed. 2.

Learned counsel for the petitioner submits that still the petitioner is undergoing treatment and doctors advised him to take bed rest, as such he filed present writ petition seeking a direction to the respondents not to take coercive steps.

Ms.Anjali Agarwal, learned Standing Counsel appearing for the respondents submits that the petitioner approached the 2nd respondent

on 08.07.2019 and he himself agreed to appear on 19.07.2019. He further submits that if any difficulty is there for attending on 19.07.2019, the petitioner may submit an application and the same would be considered basing on the facts and circumstances. 4.

In view of the above facts and circumstances, it is open for the petitioner to submit an application to the 2nd respondent bringing the above facts and on such application being made, the 2nd respondent is direction to consider the case of the petitioner in accordance with law. 5.

With the above direction, the writ petition is disposed of. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed. No order as to costs. __________________________ A. RAJASHEKER REDDY, J 15th July 2019 mar
