HONOURABLE Dr. JUSTICE B.SIVA SANKARA RAO CRIMINAL PETITION No.5280 of 2015 ORDER :

This Criminal Petition is filed by the Petitioner/ accused under Section 482 Cr.P.C seeking to quash the proceedings in Crime No.16 of 2015 of Srisailam I Town Police Station, Kurnool District, registered for the offences punishable under Section 3 (1) (x) of SC, ST (POA) Act, 1989.

2) Heard learned counsel for the petitioner/ accused as well as learned public prosecutor representing 1st respondent-State before admission and before ordering notice to 2nd respondent. Perused the material on record.

3) As the material falls short for this Court, even it is the contention of the petitioner that as the bank belongs to petitioner which agreed to have purchased from original owners, the de facto complainant came there and attributing as if he abused touching his caste name foisted a false case.

4) The facts admit, entitlement to the regular bail to the petitioner, accordingly, the Criminal Petition is disposed of, giving liberty to the petitioner to surrender before the learned Special Judge and move with regular bail with notice to additional public concerned, in such event, the learned special Judge after hearing shall grant bail preferably on the same day with necessary conditions.

Needless to say, at post bail stage, the learned Magistrate concerned shall dispense with the presence of the petitioner pending investigation.

4 ) Miscellaneous petitions, if any pending, shall stand closed.
