THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION NO.3659 of 2022 ORDER:- This petition is filed under Section 438 of the Code of Criminal Procedure, 1973 (for short "Cr.P.C.") seeking pre-arrest bail to the petitioners, in the event of their arrest in connection with Crime No.310 of 2021 of EOWCSS, Cybarabad Police Station, registered for the offences punishable under Sections 406, 417, 418, 420, 467 and 468 r/w.34 and 120 (b) of Indian Penal Code. 2.
Heard the learned Counsel appearing for the petitioners and learned Assistant Public Prosecutorrespondent, for the State. 3.
The case of the prosecution is that, a Society was formed in the name of 'Vivekananda BHEL Employees MAC Housing Building Society Limited', which is a registered Society and they released a brochure on 11.11.2018 stating that houses will built in 200 Square
Yards area and for that each Member has to pay Rs.38,75,000/- towards cost of each plot. For the said reason, the de facto complainant paid an amount of Rs.5,11,000/-, however, no plot was given to him by the society. The petitioners are employees and also Members of the said Society. The accused No.1, D.Srinivas Rao, who is the President of the said Society was arrested and later he was released on bail. The Fist Information Report points towards complicity of the President, Treasurer and Secretary, however, these petitioners are not Committee Members, however, they are Members of the Society. Since the evidence is documentary in nature, custodial interrogation of these petitioners may not be required, the petitioners can be can be granted the relief of anticipatory bail. 4.
The Criminal Petition is, accordingly, allowed and the petitioners 1 to 9 are granted anticipatory bail subject to the following conditions:
(1) The petitioners 1 to 9 are directed to surrender before the Station House Officer, EOWCCS, Cyberabad , within ten days from the date of this order, and, on such surrender, the petitioners are directed to be released on bail on their each executing a personal bond to the tune of Rs.20,000/- (Rupees twenty thousand only) with two sureties to the like sum each to his satisfaction.
(2) The petitioners shall abide by the other conditions stipulated in Section 438(2) Cr.P.C and co-operate with the Investigating Officer in investigating the case as and when required.
Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
