THE HON'BLE SRI JUSTICE A. SHANKAR NARAYANA SAMP.No.1388 of 2017 IN/AND SECOND APPEAL No.75 of 2013 COMMON ORDER:

Sri G.Sundaresan, learned counsel representing Sri A.Mahadev, learned counsel for the appellant, would submit that the parties have settled the dispute in relation to which the present Second Appeal is filed out of Court and, therefore, the appellant is not desirous of pursuing the Second Appeal. In this regard, SAMP.No.1388 of 2017 is also filed seeking permission to withdraw the appeal in terms of the Memorandum of Understanding entered into between the parties. In view of the above, SAMP.No.1388 of 2017 is allowed and the Second Appeal is dismissed as withdrawn.

Miscellaneous applications, if any pending in the instant appeal, stand closed.
