HON'BLE SRI JUSTICE S.V. BHATT WRIT PETITION No.6249 of 2015 Heard the learned counsel for petitioner and Sri A.Sudhakar Reddy, learned Government Pleader for Public Enterprises.

2. The petitioner assails proceedings R.C.No. 6B/2010/DisableIDnumbers/J.A.-1, dated 28.02.2015.

Through the impugned proceedings, the 2nd respondent orders the 4th respondent to recover a sum of Rs.43,000/- along with interest under Revenue Recovery Act from the petitioner. The 2nd respondent further directs cancellation of allotment of house bearing I.D.No.121728536P31203412 in favour of the petitioner.

3. The grievance of the petitioner is that through the impugned proceedings, the 2nd respondent directs recovery of a sum of Rs.43,000/- and cancellation of house patta in favour of the petitioner. The petitioner was not put on notice before any decision is taken by the 2nd respondent. Admittedly, the proceeding does not refer to affording opportunity to the petitioner. With a view to avoid further delay in the matter, prima facie I am satisfied that the proceeding is violative of principles of natural justice, on this short ground the impugned proceeding is set aside and the matter is remitted to the 2nd respondent for consideration afresh. It is needless to observe that the

2nd respondent before proceeding further in the matter, makes available the reports and puts the petitioner on notice, receives explanation and passes appropriate orders.

4. The writ petition is ordered as indicated above. No order as to costs.

5. Miscellaneous Petitions pending, if any, shall stand closed.
