THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.41038 of 2016 ORDER:

This writ petition under Article 226 of Constitution of India is filed seeking to declare the action of the 3rd respondent in not conducting further investigation in Crime No.300 of 2016, dated 03.09.2016, against the 4th respondent, as illegal and arbitrary. The petitioner lodged the present complaint against the 4th respondent alleging that the 4th respondent has obtained contract work from the Government of Telangana and subsequently the work was assigned through letter of award, dated 21.04.2014, and that after receipt of letter of award, the petitioner started the work with big machinery and huge labourer and completed the work under the supervision of the 4th respondent and that on the date of completing the work, the 4th respondent is due an amount of Rs.

42,73,520/- and the petitioner requested to release the amounts as per the contract, but till now, the 4th respondent neither paid any amount to him nor issued any reply to the petitioner. Basing on the said complaint, the 3rd respondent registered the same as Crime No.300 of 2016, but the 3rd respondent is not taking any action against the 4th respondent. Considering the grievance of the petitioner, the 3rd respondent is directed to complete the investigation in Crime No.300 of 2016 as expeditiously as possible and file a final report, if any, either way in accordance with law.

Accordingly, the Writ Petition is disposed of. No costs. Pending Miscellaneous Petitions, if any, shall stand closed. ___________________ RAJA ELANGO,J Date: 25th November, 2016 KL
