THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION NO.3681 of 2022 ORDER:- This petition is filed under Section 438 of the Code of Criminal Procedure, 1973 (for short "Cr.P.C.") seeking pre-arrest bail to the petitioner-accused, in the event of his arrest in connection with Crime No.17 of 2021 of Amangal Police Station, Cyabarabad, Ranga Reddy District registered for the offences punishable under Sections 468 and 471 r/w.34 of Indian Penal Code. 2.

Heard the learned Counsel appearing for the petitioner and learned Assistant Public Prosecutorrespondent, for the State. 3.

The learned Counsel for the petitioner submits that the neither in the complaint nor in the remand report there are overt acts against the petitioner and his name is not mentioned in the complaint. The petitioner retired from service on 31.12.2011 as Deputy General Manger

of DCC Bank, Head Office, Mahabubnagar, and he has no connection with the other accused, and hence, requested for grant of anticipatory bail to the petitioner. 4.

On the other hand, learned Assistant Public Prosecutor submits that there are specific overt acts against Accused No.1 to 3 and that the petitioner failed to verify the names of the borrowers.

Taking into consideration the fact that main allegation is against Accused No.1 to 3, this court deems it appropriate to grant bail to the petitioner. 6.

The Criminal Petition is, accordingly, allowed and the petitioner is granted anticipatory bail subject to the following condition:

(1) The petitioner is directed to surrender before the Station House Officer, Amangal, Cyberabad, within ten days from the date of this order, and, on such surrender, the petitioner is directed to be released on bail on his executing a personal bond to the tune of Rs.20,000/- (Rupees twenty

thousand only) with two sureties to the like sum each to his satisfaction.

(2) The petitioner shall abide by the other conditions stipulated in Section 438(2) Cr.P.C and co-operate with the Investigating Officer in investigating the case as and when required.

Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
