O R D E R

This Criminal Petition is filed before this Court for grant of bail to the Petitioner who is arrayed as accused No.4 in FIR No.374 of 2026 of Attapur Police Station, Hyderabad District, registered for the offences punishable under Sections 126(2), 109(1), 115(1), 352, 351(1) r/w 3(5) of the BNS.

The case of the prosecution is that, on 02.04.2026, the de-facto complainant lodged a report before the police stating that that the complainant while doing pan shop business at Arman Pan Shop, the complainant standing at his pan shop at the time of four unknown persons came to him ask cigarettes and he told to them that he will open the pan shop after 05:00 hrs and they abused him in filthy language and threatened him with dire consequences and they left from the said place. After few minutes said four persons and other persons came to him and started abusing in filthy language and beat the complainant with hockey sticks and their hands. As a result, he received bleeding injuries on his head, face and other parts of the body. Immediately a person Jameel and others persons were interfere the said issue and shifted him to Hospital. Hence, the complainant requested to take necessary action. Basing on the same, the police registered a case for the above said offences.

Heard Sri Khaja Arajuddin, learned counsel appearing on behalf of the petitioner as well as Sri M.

Learned counsel for the petitioner submitted that the petitioner is innocent of the said allegations and he is a student pursuing his intermediate education and he never involved in any crime and he is in jail since 04.04.2026 and the entire investigation is already completed.

Therefore, he prayed the Court to grant bail to him by allowing this criminal petition.

On the other hand, learned Additional Public Prosecutor opposed the submissions made by the learned counsel for the petitioner stating that the allegations against the petitioner herein are serious in nature and the offence under Section 109(1) of the BNS is a grave offence and the investigation is not yet completed. Therefore, he prayed the Court to dismiss the criminal petition. 6.

In the light of the submissions made by both the learned counsel and upon perusal of the material available on record, it appears that the petitioner herein is accused

- 4 - No.4 and he is in jail since 04.04.2026. As seen from the remand case diary, the prosecution witnesses, LWs 1 to 10 have already been examined. Further, the allegations against the petitioner herein are that he participated in the said crime and indiscriminately kicked the de-facto complainant. Considering the facts and circumstances of the case, the nature of the allegations, the stage of investigation, the duration of incarceration and the injuries of the de-facto complainant, this Court finds it appropriate to grant bail to the petitioner, subject to the following conditions:

i.

The petitioner shall execute a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only), with two sureties for a like sum each to the satisfaction of the learned XXV Additional Judicial Magistrate, at Rajender Nagar, Cyberabad, R.R. District.

ii.

The petitioner shall appear before the concerned SHO at 11:00 a.m., on

- 5 - every Monday for a period of eight (8) weeks or till filing of charge sheet whichever is earlier, for the purpose of investigation, and thereafter, as and when required.

iii.

The petitioner shall abide by the conditions stipulated in Section 437(3) of Cr.P.C. (presently, Section 480(3) of the BNSS).

Accordingly, the Criminal petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
