HON'BLE SRI JUSTICE S. RAVI KUMAR Tr.CIVIL MISCELLANEOUS PETITION No.696 of 2014 ORDER:
This petition is filed to withdraw O.P.No.27 of 2014 from the file of III Additional Senior Civil Judge, Kakinada and transfer the same to Additional Family Court, City Civil Court, Hyderabad to be tried along with O.P.No.732 of 2014.
2. Petitioner herein is wife and she filed her affidavit in support of petition, according to which, her marriage was performed with respondent on 30.11.2011 at Sri Sai Gardens, Mallapur, and due to disputes, she is living separately. She stated that she filed divorce O.P.No.732 of 2014 before Additional Family Court, City Civil Court, Hyderabad and also filed a criminal case under Section 498-A IPC and the same is pending before XIII Additional Chief Metropolitan Magistrate, Hyderabad and the respondent/husband filed O.P.No.27 of 2014 for dissolution of marriage before III Additional Senior Civil Judge, Kakinada. She stated that it is difficult for her to travel from Hyderabad to Kakindada and she has to incur expenses. She further stated that respondent is working at Bangalore and O.P.
is filed at Kakinada only with a view to harass petitioner and also for the reason that his father is a retired Public Prosecutor at Kakinada, who got influence. For these reasons, she prayed for transfer of O.P.No.27 of 2014 from III Additional Senior Civil Judge, Kakinada to Additional Family Court, City Civil Court, Hyderabad.
3. Respondent in spite of service of notice neither appeared in person nor through any advocate.
4. Heard argument of advocate for petitioner.
5. Advocate for petitioner submitted that respondent is working at Bangalore and it will be convenient for him to reach Hyderabad from Bangalore instead of reaching Kakinada.
6 . I have perused the material papers including affidavit of petitioner. Considering the reasons stated in the affidavit and also considering the
convenience of wife, I feel that the request of petitioner/wife can be considered by transferring O.P.No.27 of 2014 from III Additional Senior Civil Judge, Kakinada to Additional Family Court, Hyderabad to be tried along with O.P.No.732 of 2014 for disposal in accordance with law.
7. Accordingly, the Transfer Miscellaneous Petition is ordered. No costs. As a sequel, miscellaneous petitions, if any filed in this civil miscellaneous petition, shall stand closed.
