Heard counsel for the petitioners, the Government Pleader for Home appearing for 1st respondent, the Government Pleader for Finance & Planning appearing for respondents 2 to 4, and Sri V.Sreenivasa Rao, Standing Counsel for 5th respondent.

Petitioners'

grievance is that an amount of Rs.19,81,000/- was seized from the petitioners' custody by the 5th respondent at the time of general elections on 26.04.2014, that the criminal proceedings initiated against the petitioners were quashed by this Court on 10.09.2015 in Crl.P.No.5612 of 2015, but the money which was in the custody of the 5th respondent has not been returned to the petitioners.

Sri V.Sreenivasa Rao, Standing Counsel appearing for 5th respondent states that the 5th respondent possesses only key of the box, in which the money is stored, and that the 5th respondent has no objection to return the key to the petitioners.

The Government Pleader for Finance & Planning appearing for respondents 2 to 4 states that if there is a requisition from the 5th respondent for return of the box

containing the money, the respondents 2 to 4 have no objection for giving that box to the 5th respondent. 5.

Respondents 2 to 6 do not dispute the entitlement of the petitioners to receive the said money.

In view of these facts, the Writ Petition is disposed of directing the 5th respondent to forthwith submit a requisition to 3rd respondent for return of the box containing the money belonging to the petitioners. On receipt of the said requisition from the 5th respondent, the 3rd respondent shall immediately return the box containing the money to the 5th respondent. Thereupon, on the petitioners approaching the 5th respondent and proving their identity, the 5th respondent shall return the box containing the money along with the key to the petitioners. This exercise shall be completed within a period of two (02) weeks from the date of receipt of a copy of this order. There shall be no order as to costs.

Consequently, miscellaneous petitions pending, if any, shall stand dismissed.
