THE HON'BLE SRI JUSTI CE SANJAY KUMAR AND THE HON'BLE SRI JUSTI CE P.KESHAVA RAO WRI T PETI TI ON NO.14436 OF 2019 ORDER: (per SK,J) The prayer of the petitioner in this case reads as under: 'For the reasons stated in the accompanying affidavit it is therefore prayed that this Honourable Court may be pleased to issue an appropriate writ, order or direction more particularly one in the nature of writ of Mandamus, declaring the action of the respondents for not considering the request of the petitioner as arbitrary, illegal, unjust, without jurisdiction, contrary and violation of Article 14 of the Constitution of India, consequently direct the 1st Respondent to receive and consider the application along with original certificate of the petitioner for verification and admission in to MBBS and BDS - 2019-20 degree course under 15% Non local quota in affiliated colleges of the 1st Respondent in the interest of justice.'

Though Sri Adhi Venkateshwar Rao, learned counsel for the petitioner, would contend that the petitioner was placed in a dire situation owing to the ill-health of his mother and her hospitalization whereby he failed to submit his application online or participate in the ensuing process for admission into MBBS and BDS courses during the academic year 2019, we find that it is too late in the day for the petitioner to now seek any relief.

Be it noted that the petitioner belongs to a reserved category and Kaloji Narayana Rao University of Health Sciences, Warangal, the first respondent, would also have to undertake verification of the said aspect apart from verification of the original certificates of the petitioner. Sri A.Prabhakar Rao, learned counsel for the first respondent university, would inform this Court that the entire process has already been

completed and the third phase of counselling for this category of seats is scheduled to be held from 31.07.2019.

In that view of the matter, we are of the opinion that no indulgence can be shown to the petitioner as he has no one to blame but himself for not taking timely measures to get his candidature considered for admission to MBBS/BDS course during this academic year. Reliance placed by Sri Adhi Venkateshwar Rao, learned counsel, on the orders passed by this Court on 01.07.2019 is misplaced as those orders stood on a different footing, inasmuch as the petitioners therein approached this Court within time, unlike the petitioner.

The writ petition is accordingly dismissed on this short ground. Pending miscellaneous petitions, if any, shall also stand dismissed. No order as to costs.
