THE HON'BLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.807 OF 2016 ORDER:
This criminal petition under Sections 437 and 439 of the Code of Criminal Procedure is filed by the petitioners/A.1 and A.3 seeking bail in crime No.245 of 2015-16 on the file of the Narsipatnam Prohibition and Excise Police Station, Visakhapatnam District, registered for the offences under Section 8(c) read with Section 20(b)(ii)(c) of the Narcotic Drugs and Psychotropic Substances Act (NDPS Act). Heard and perused.
The allegation against the petitioner/A.1 and A.3 is that the petitioners and the other accused were found in illegal possession of 120 kgs of ganja.
Learned counsel for the petitioners submits that the petitioners have not committed any offence and they have been falsely implicated in the case. He prays this Court to grant bail to the petitioners. Considering the fact that the quantity of ganja, which was found in possession of petitioners/A.1 and A.3 is commercial quantity, this Court is not inclined to grant bail to the petitioners/A.1 and A.3.
