HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.14453 OF 2019 O R D E R :

This writ petition is filed challenging the action of the respondents in not allotting the tender auction in favour of the petitioner as per tender notification No.F.No.13/RR/DJP/Auction/ 2018, dt.27.06.2019, conducted on 06.07.2019, as per clause 8(a) of the auction conditions. Sri Farhan Azam Khan, learned Standing counsel for 2nd respondent produced written instructions stating that within three working days from the date of opening of tenders, the successful bidder (3rd respondent) paid the entire auction amount, as such there is no violation of tender conditions; and that the difference between the petitioner and 3rd respondent in respect of bid amount is almost 60 lakhs and odd, as such, there is no infraction of any law. He further submits that vide proceedings dt. 11.07.2019, work was allotted to 3rd respondent. Learned counsel for the petitioner states that the writ petition may be disposed of granting liberty to the petitioner to challenge the proceedings dt.11.07.2019.

Recording the aforesaid submissions of both the counsel, the writ petition is disposed of granting liberty to the petitioner to challenge the proceedings dt.11.07.2019, in accordance with law. No order as to costs. As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed.
