This Writ Petition was filed challenging the registration of Crime No.620 of 2016 of Saifabad Police Station, Hyderabad City, by the third respondent for the offences punishable under Sections 406, 420 IPC read with Section 12(b) of the Indian Passport Act and Section 24(1)(b) of the Emigration Act. The said crime was registered on the basis of information furnished by the fourth respondent. The petitioner states that the crime was registered against him on the basis of alleged confession made by the second accused and he is no way concerned with the same. The sum and substance of the complaint is that the fourth respondent, on receiving credible information along with two mediators, raided the premises of New Alfa International Human Resource Consultant, situated at Plot No.62-47, Block C, Third Floor, Yeturu A.C.

Guard, Lakdikapool, Hyderabad, wherein the second accused was apprehended. The petitioner is stated to be a proprietor of the said firm. The second accused stated that he is operating the agency on behalf of the petitioner and cheating innocent people by promising to provide jobs in foreign countries by collecting Rs.20,000/- to Rs.25,000/- from each person. He also used to collect original passports of the candidates and cheated about 350 to 400 candidates under the guise of providing jobs. The said business is being run without obtaining any permission from the Protector General of Emigration, Ministry of Labour, Government of India.

Now a crime is registered and it is under investigation stage. At this stage, it cannot be said that the registration of the crime on the basis of the report of the fourth respondent is illegal. A reading of the complaint shows that there is a prima facie case for registration of the crime and this Court is not inclined to interfere with the same. The Writ Petition is, accordingly, dismissed. There shall be no order as to costs.

As a sequel thereto, the miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
