THE HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.32172 of 2017 ORDER:
This Writ Petition, under Article 226 of the Constitution of India, came to be filed seeking the following relief: " ... declaring the action of the respondents 1 to 5 in taking steps to pay the compensation amounts under the Rehabilitation & Resettlement Scheme of Polavaram Project in favour of the 6th & 7th respondent herein, in respect of the house bearing No.2-49 & 2-89 (Assessment No.199 & 231) situated at Uppaeru Village of Kukunuru Mandal of West Godavari District, without considering the claim petition dt:3-8-2017 as illegal, arbitrary ....."
Heard the learned counsel for the petitioner and the learned Government Pleader for Land Acquisition.
Since this Court is not going into the merits of the case, there is no necessity to issue notice to respondents 6 and 7. Learned counsel for the petitioner would submit that without considering the objections filed by the petitioner, the authorities are trying to release the amounts.
Learned GP disputes the same stating that the matter is still at the stage of surveying, as such, the question of releasing the amounts would not arise, at this stage.
Having regard to the rival submissions made, the respondents shall consider the objections raised by the petitioner while dealing with the matter, within a period of three weeks from the date of receipt of a coy of this order, in accordance with law,
Miscellaneous petitions pending in this writ petition, if any, shall stand closed. There shall be no order as to costs. _______________________ C. PRAVEEN KUMAR, J 21.09.2017 sur
