HON'BLE SRI JUSTICE T. VINOD KUMAR WRIT PETITION NO.14447 OF 2019 ORDER:

This Writ Petition is filed by the petitioner to declare the action of respondent Nos.4 and 5 in threatening the witnesses who come forward to give evidence in Cr. No.154 of 2019 for offence under Section 307 read with Section 34 of IPC in collusion with the accused.

Heard the learned Counsel for the petitioner and the learned Assistant Government Pleader for Home. Learned Assistant Government Pleader for Home, on written instructions dated 12.11.2019 which is placed on the file of this Court, would submit that on the complaint of the petitioner, a case was registered in Crime No.154 of 2019 of Huzurnagar police station on 24.06.2019. The petitioner had made allegations against respondents 4 and 5 in the Writ Petition as threatening the witnesses who come forward to give evidence in the case. As per the directions of the SubDivisional Police Officer, Kodad vide C.No.184/Cr/SDPOK/2019 dated 31.07.2019, the investigation has been transferred to the Inspector of Police Kodad Town who took up investigation in the matter. By the said written instructions, it is stated that during the course of investigation, the Investigating Officer examined L.Ws-1 to 8 and recorded their statements, arrested the accused 1 and 3

on 26.09.2019 and remanded them to judicial custody and accused No.2 obtained anticipatory bail from this Court in Criminal Petition No.3666 of 2019. It is submitted that the statement under Section 161 Cr.P.C. of L.Ws.4, 7 and 8 were recorded on 17.08.2019.

Learned Assistant Government Pleader would submit that the authorities would file final report in the matter, after obtaining opinion of the Public Prosecutor in the Court below and the entire exercise will be completed within a period of four weeks.

Recording the above submission made by the learned Assistant Government Pleader, on the basis of written instructions, no further orders are required to be passed. Accordingly, the Writ Petition is closed. No costs. Miscellaneous petitions, pending if any, shall stand closed.
