HON'BLE THE CHIEF JUSTICE SRI THOTTATHIL B. RADHAKRISHNAN AND HON'BLE SRI JUSTICE P. KESHAVA RAO WRIT APPEAL No.794 OF 2017 JUDGMENT (ORAL): (Per Hon'ble The Chief Justice Sri Thottathil B. Radhakrishnan) This Writ Appeal is by the writ petitioner.

The writ petitioner claimed that he was given right to operate a milk parlour of a cooperative society which is respondent No.4 viz., Andhra Pradesh Dairy Development Cooperative Federation Limited. The said respondent denied issuance of any proceeding which the petitioner sought to rely on before the learned single Judge. The writ petitioner sought for issuance of an order in relation to operation of the 1st N.C. Vijaya Dairy Parlour at Tirumala. The learned single Judge found that the situation in hand is one in which no right to sue particularly when there is a First Information Report involving the writ petitioner on the grounds of forgery and also because the matter is not justifiable in writ jurisdiction. Hence, we do not find any ground to interfere with the decision of the learned single Judge that a writ petition does not lie.

3. The Writ Appeal, therefore, fails and is dismissed. There shall be no order as to costs.

HCJ & PKR,J WA No.794 of 2017 As a sequel thereto, Miscellaneous Applications, if any, pending in the Writ Appeal stand dismissed.
