THE HON'BLE SRI JUSTICE SURESH KUMAR KAIT CONTEMPT CASE No.179 OF 2017 ORDER (ORAL):
The respondent No.1 has filed counter affidavit, whereby stated that order, dated 27.08.2016 has been complied with. Learned counsel appearing on behalf of the petitioner does not dispute the contents of the counter affidavit filed by the respondent No.1 and has prayed this Court let the present petition be disposed of.
The present petition was filed for punishing the respondents by not implementing the order of this Court, dated 27.08.2016, passed in W.P.No.31988 of 2015. Vide aforesaid order, the respondents were directed to take steps to deposit the decretal amount within two months from the date of receipt of copy of the said order. It was further made clear that if the decretal amount is not deposited within the time stipulated by this Court, the petitioner is entitled to interest @ 12% p.a., on delayed payment. As stated in the affidavit, the respondents have paid the decretal amount with interest @ 12% p.a., on delayed payment. In view of the above, I hereby discharge the respondents from the contempt proceedings.
