THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.39498 OF 2016 ORDER:

This writ petition, under Article 226 of the Constitution of India, is filed seeking to declare the action of respondent No.1 in not issuing sale certificate by registering the properties in favour of the petitioner, who participated in the open public auction held on 21.1.2015 in the premises of respondent No.1 as per the auction notification, dated 10.10.2014, and stood as successful bidder in the open public auction and paid the entire sale consideration as per the terms of the auction, as illegal and arbitrary and consequently, to direct respondent No.1 to register the properties i.e., land admeasuring Ac.1.20 guntas in Sy.No.208/A and the land admeasuring Ac.1.11 guntas in Sy.No.208/B totalling Ac.2.31 guntas situated in Shanagar Revenue Village, Ramadugu Mandal, Karimnagar District in favour of the petitioner by delivering peaceful possession to him.

Heard and perused the material available on record. 3.

The petitioner filed the present writ petition without impleading the State of Telangana as a party. The Numbering Section also wrongly numbered the writ petition. Hence, the writ petition is not maintainable and is liable to be dismissed. 4.

Accordingly, the Writ Petition is dismissed. However, if the petitioner has any grievance over the inaction of the Court concerned, he is at liberty to approach the appropriate Forum by invoking the appropriate provision. There shall be no order as to costs.

Miscellaneous Petitions pending, if any, in this Writ Petition shall stand closed.
