THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.1780 of 2016 ORDER:

This Criminal Petition is filed by the petitioner-A14 under Section 482 Cr.P.C. seeking to quash the proceedings against him in M.C.No.16 of 2015 on the file of the 2nd respondent-Sub Divisional Magistrate & Revenue Divisional Officer, Nandyal, Kurnool District. Heard and perused the material available on record. According to the prosecution, as it was reported that the petitioner and other accused, who got bail in Crime No.157 of 2015 of Allagadda Police Station, formed into an unlawful assembly near the house of Injeti Nagi Reddy and discussed to threat the witnesses in the above crime, the petitioner and others were directed by the 2nd respondent vide notice in the above M.C., to appear on 30.1.2016 at 11 a.m., at Sub-Collector's Office, Nandyal, for giving explanation. There was no direction for execution of any bond. It is only a direction to appear before the officer concerned to conduct enquiry. It is the apprehension of the petitioner that he may be compelled to execute a bond under Section 107 Cr.P.C.

Considering the facts and circumstances of the case, the 2nd respondent/the officer concerned is directed to conduct an enquiry on the basis of the notice issued in the above M.C, after giving an opportunity to the petitioner to make his submissions as to why it is not necessary for him to execute a bond under Section 107 Cr.P.C., and pass appropriate orders in accordance with law. With the above directions, the Criminal Petition is disposed of. Consequently, miscellaneous petitions pending, if any, shall stand

closed.
