HON'BLE SRI JUSTICE S. RAVI KUMAR Tr.CIVIL MISCELLANEOUS PETITION No.675 of 2014 ORDER:

This petition is filed to withdraw O.P.No.1271 of 2014 from the file of Additional Family Court, City Civil Court, Hyderabad and transfer the same to Senior Civil Judge, Mangalagiri, Guntur District for disposal in accordance with law.

2. Petitioner herein is wife and she filed her affidavit in support of petition, according to which, her marriage was performed with respondent on 08.06.2003 at Seethanagaram Village, Tadepalli Mandal, Guntur District and they are blessed with a female child, by name, K. Amrutha Varshani, aged 12 years, studying in 5th standard and a male child, by name, K. Aditya, aged 9 years, studying in 4th standard at Ramakrishna Mission High School at Seethanagaram Village, Tadepalli Mandal. She further stated that respondent/husband filed O.P.No.1271 of 2014 before Additional Family Court, Hyderabad for divorce and that she has no male assistance to accompany her from Seethanagaram Village to Hyderabad for defending O.P.No.1271 of 2014. She further stated that it is difficult for her to travel 290 KMs from Seethanagaram to reach Hyderabad, which is also expensive. For these reasons, she prayed for transfer of O.P.No.1271 of 2014 from Additional Family Court, City Civil Court, Hyderabad to Senior Civil Judge, Mangalagiri, Guntur District.

3. Respondent in spite of service of notice neither appeared in person nor through any advocate.

4. Heard argument of advocate for petitioner.

5. Advocate for petitioner submitted that petitioner/wife also filed Family O.P. before Senior Civil Judge, Mangalagiri for restitution of conjugal rights and taking the convenience of wife into consideration, O.P.No.1271 of 2014 pending before Additional Family Court, Hyderabad may be transferred to Senior Civil Judge, Mangalagiri.

6. I have perused the material papers and also affidavit filed in support of transfer petition. Considering the reasons stated in the affidavit and also considering the convenience of petitioner/wife, O.P.No.1271 of 2014 is withdrawn from Additional Family Court, City Civil Court, Hyderabad and transferred to Senior Civil Judge, Mangalagiri, Guntur District for disposal in accordance with law.

7. Accordingly, the Transfer Miscellaneous Petition is ordered. No costs. As a sequel, miscellaneous petitions, if any filed in this civil miscellaneous petition, shall stand closed.
