THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.36555 of 2016 ORDER:

This writ petition is filed by the petitioner under Article 226 of the Constitution of India seeking to quash the proceedings against him in Crime No.863 of 2016 on the file of KPHB Police Station, Cyberabad, Ranga Reddy District.

Heard and perused the material available on record. The 3rd respondent made a complaint against the petitioner alleging that the petitioner met her in December 2015 and developed illegal intimacy on the promise to marry her and they are living together without there being any marriage, and subsequently, she came to know that the petitioner already got married, and when she insisted him about their marriage, he demanded one crore rupees. Learned counsel for the petitioner submits that the petitioner never had any relationship with the 3rd respondent and only to attract money from him, the present complaint is filed with all false allegations and the petitioner is ready to cooperate with the investigation, therefore, requested to quash the proceedings against him in the above FIR.

Even though this Court is not inclined to interfere with the investigation, taking into consideration the facts and circumstances of the case this Court is of the view that the investigation in the above crime can be completed without arresting the petitioner. Accordingly, respondent No.2 is directed to complete the investigation and file a final report, in the above Crime, in accordance

with law in either way, without arresting the petitioner. The petitioner is also directed to appear before the investigating officer concerned, as and when required, and cooperate with the investigation. With the above direction, the Writ Petition is disposed of. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
