This writ petition is filed challenging the proceedings in Lr.No.7/B/TPS/C7/W10/GHMC/2011, dated 21-09-2011 issued by the 4th respondent under Section 450 of the Greater Hyderabad Municipal Corporation Act, 1955 revoking BPS permission obtained by the petitioner on the ground of material misrepresentation.

2. Learned counsel for the petitioner as well as the learned standing counsel for the respondent-Corporation submitted that alternative remedy of appeal under Rule 11 of the A.P. Regulation and Penalization of unauthorisedly Constructed Buildings and Buildings Constructed in deviation of the Sanctioned Plan Rules, 2007 (for short "the Rules"), as amended vide G.O.Ms.No.395, dated 17-06-2009, is available to the petitioner before the Committee constituted by the Government against the impugned

proceedings. Learned counsel for the petitioner seeks permission to avail such alternative remedy provided under the above provision.

In view of the same, the writ petition is disposed of permitting the petitioner to avail the alternative remedy of appeal provided under Rule 11 of the Rules before the Committee constituted by the Government against the proceedings impugned herein.
