THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.38040 OF 2016 ORDER:

This writ petition is filed seeking to issue a writ or order more particularly, one in the nature of writ of mandamus to declare the action of the respondents in interfering with the petitioner's possession and construction in house plot bearing No.1-1-380/18/A (New) 1-1-380/18 (Old) situated at New Bakaram, Gandhinagar, Hyderabad as illegal and arbitrary and consequently, to direct the respondents not to interfere in petitioner's possession and construction in the said house plot. 2.

Heard and perused the material available on record. 3.

Learned counsel for the petitioner contended that without there being any crime registered against the petitioner, respondent No.3 is interfering in the civil disputes pending before the petitioner and the State Government.

Learned Assistant Government Pleader for Home denied the entire allegations and submitted before this Court that respondent No.3 will not interfere in any of the civil disputes pending before the petitioner and the State Government.

Considering the facts and circumstances of the case, without expressing any opinion on merits, this Court is of the view that the writ petition can be disposed of with the following directions: Respondent No.3 should not interfere in the affairs of the petitioner without there being a case registered for a cognizable offence and he can interfere only if there is a possibility of law and

order problem and without there being any law and order problem or any case registered against the petitioner, he should not interfere in any of the affairs of the petitioner. 6.

Accordingly, the Writ Petition is disposed of. There shall be no order as to costs.

Miscellaneous Petitions pending, if any, in this Writ Petition shall stand closed.
