23.02.2021 LK,J I.A.No.1 of 2022 This application is filed by the petitioner/accused seeking relaxation of condition No.(2) imposed by this Court, by order, dated 17.11.2021. i.e., the 1st petitioner shall personally appear before the 2nd respondent authorities on the 1st and 3rd Monday of every month between 12.00 Noon and 5.00 P.M., till completion of investigation.

Learned counsel for the petitioner submits that the petitioner has been complying with the said condition and in view of his employment, it has become difficult for him to comply with the said condition. He submits that entire investigation is completed. Hence, the said condition may be relaxed.

A counter-affidavit has been filed by respondent No.2 stating that the petitioner is appearing before the police, but he is not cooperating with the investigation and many crucial supporting documents in connection with the suspicious financial transactions with third parties are not placed before the prosecution. In view of the same, the said condition may not be relaxed.

Taking into consideration the fact that the petitioner has been continuously appearing before the Enforcement

Directorate Authorities, this Court deems it appropriate to modify the said condition as follows 'the petitioner shall appear before the 2nd respondent authorities once in two months or whenever his presence is required. Further, the 2nd respondent authorities shall give an advance notice to the petitioner in this regard.'.

Accordingly, this application is ordered.
