Heard learned counsel for petitioner and the learned Government Pleader for R & B.

Petitioners claimed to be the residents of Katlakunta village, Medipalli mandal, Jagithyal district and they own residential houses in the said village. According to petitioners, the respondents have taken a decision to widen the existing road to a two lane road and developmental activities are going on and in the said process, the authorities have also marked houses of the petitioners and petitioners apprehend that there is a threat of demolition and their houses would be demolished without following due process of law. Apprehending such danger, the present writ petition is filed 3.

On instructions, the learned Government Pleader submits that the road from Medipalli village to Raikal is sanctioned for widening and strengthening under Central Road Fund and the road construction includes widening from single lane to double lane which is passing through the villages Medipally, Katlakunta, Maithapur and Raikal and the road widening is being carried out in the reaches wherever the land is available for widening and the road reach passing through Katlakunta village is narrow i.e. single lane and habitations are present on both sides of the road. Learned Government Pleader further submits that if the land is required on this stretch which may result in removal of existing structures, due process of law would be followed.

Having regard to the aforesaid submission, the writ petition is disposed of, directing the Respondents to follow due procedure of law before taking steps for acquiring private properties, if any, for public purpose including widening of road, particularly in Katlakunta village. As a sequel, the miscellaneous applications, if any, shall stand closed.
