The petition coming on for hearing, upon perusing the Petition and the affidavit filed in support thereof and upon hearing the arguments of N V ANANTHA KRISHNA Advocate for the Petitioner, and of PUBLIC PROSECUTOR, for the Respondent, the Court made the following. ORDER:

/ TF E HONOURABLE JUSTICE G. SRI DEVI CRIMINAL PETITION No.4008 of 2019 ORDER:

This Criminal Petition, under Section 438 of the Code of Criminal Procedure, '1973, is filed by petitioner/A7, seeking to grant anticipatory bail in Crime No.124 of 2019 of Saroornagar Police Station, Rachakonda District, registered for the offences under Sections 324, i\42,365, 387 read with Section 34 lPC. 2.

Heard learned counsel for the petitioner/A7, learned Additional Public Prosecutor representing the respondent-State and perused the record.

lt is alleged in the complaint that on account of the criminal case filed by the de-facto complainant due to dishonour of cheque for a sum of Rs.5,00,000/- issued by 41 in the year 2014, all the accused took the de-facto complainant on 10.01 .2009 to ECIL on car, obstructed in a house, beat him with sticks and obtained his signatures on Rs.100 bond papers, 10 promissory notes, 10 green color concord papers and 10 white papers.

Learned counsel for the petitioner/A7 would submit that the 't petitioner is not aware of the allegations made in the complaint and that all the allegations are false and baseless. He would further submit that the petitioner has no nexus with the alleged crime and all the allegations are invented for the purpose of case and that the petitioner is ready to abide by the conditions that may be imposed by this Court.

Learned Additional Public Prosecutor representing the respondent-State opposed to grant anticipatory bail to the petitioner.

Having regard to the facts and circumstances of the case and in view of the nature of the allegations leveled against the petitioner, this Court is inclined to grant anticipatory bail to the petitioner/A7 on some conditions.

Accordingly, the Criminal Petition is allowed and the petitioner/A7 is directed to surrender before the Station House Officer, Saroornagar Police Station, Rachakonda District, within a period of 15 days from the date of this order. On such surrender, the said Station House Officer shall release the petitioner/A7 on bail, on his executing a personal bond for a sum of Rs.10,0001 (Rupees ten thousand only) with two sureties for a like sum each to his satisfaction. On such release, the petitioner/A7 shall abide by the conditions stipulated in Section 438(2) Cr.P.C and co-operate with the investigating officer in investigating the case. 8.
