Heard.

2. Petitioner was an ex-Municipal Councilor of Mancherial Municipality. This Writ Petition is filed alleging that he filed several complaints against inclusion of bogus voters in various Wards of the Municipality. Those votes are not deleted and continued to be reflected in the municipal records. Alleging inaction, this Writ Petition is filed.

3. From the material on record, it is seen that the petitioner filed complaint to the District Collector, Mancherial. Copy of the later representation was marked to the Revenue Divisional Officer. Other representations are made to the Municipal Commissioner. As per the provisions of the Municipality Act, 1965, and the procedure evolved by the State Election Commission, the voters' list published under the Representation of Peoples Act, 1951, is the basis for determining the voters in a Municipality. Therefore, if the petitioner has any grievance against the wrong entries made in the voters' list, he has to submit an application to the Electoral Registration Officer, who represents the Election Commission of India, to exercise powers under the provisions of Representation of Peoples Act, 1951. The Revenue Divisional Officer in the State Government is the Electoral Registration officer.

4. Apparently, from the material on record, no such representation was made to the Electoral Registration Officer seeking deletion of bogus voters' names as alleged in the

representation. Therefore, the relief as sought for cannot be granted.

5. Leaving it open to the petitioner to raise objection before the Electoral Registration Officer/Revenue Divisional Officer/ 4th respondent, the Writ Petition is dismissed. Miscellaneous Petitions pending in this writ petition, if any, shall stand closed. No order as to costs.
