HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.14520 of 2019 O R D E R :

This writ petition is filed challenging the action of the respondents in taking steps for apprehending the petitioners without issuing any notice and following the procedure contemplated under Section 41-A of the Code of Criminal Procedure, 1973, in connection with Crime No.88/2018 dt.12.07.2018, on the file of the 3rd respondent. Heard learned counsel for the petitioners.

Learned Assistant Government Pleader for Home on instructions submits that the respondent police are contemplating to issue notice under Section 41-A Cr.P.C.

The petitioners are also seeking the same relief in the writ petition. Recording the aforesaid submission, the writ petition is disposed of directing the Station House Officer, Kothuru Police Station, Cyberabad-3rd respondent herein, to follow the statutory mandate in Section 41-A of the Code of Criminal Procedure, 1973, and the guidelines in Arnesh Kumar v. State of Bihar and another (2014) 8 supreme Court cases 273, while investigating into the afore-stated crime. No order as to costs. As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed.
