Chalasani Gautam v. State Of Telangana And 9 Others
THE HON'BLE SRI JUSTICE A.RAJASHEKER REDDY W.P.NO.14464 OF 2019
O R D E R
The case of the petitioner is that as Cr.No.1435 of 2017 was registered against him on the file of Police Station, KPHB Colony, Cyberabad, for the offence under Section 420 IPC, respondent - police have seized his passport bearing No. Z3463838 and issued Look Out Circular. Now the grievance of the petitioner is that though the said crime was quashed by this court in I.A.Nos.1 and 2 of 2019 in Crl.P.No.3623 of 2019 and Crl.P.No.3623 of 2019 dated 05.07.2019, owing to the compromise between the parties, the respondents are not releasing the passport and closing the Look Out Circular. Heard the learned counsel for the petitioner. On 15.07.2019, at the request of learned Assistant Government Pleader for Home, the matter was adjourned for instructions.
Today, the learned Assistant Government Pleader for Home could not dispute the fact that the crime registered against the petitioner has been quashed by this court. In view of the facts and circumstances, no useful purpose would be served in retaining the passport of the petitioner and in continuing the Look Our Circular. Hence, the respondents / competent authority, is directed to release the passport of the petitioner bearing No. Z3463838 and close the Look Out Circular issued against him.
Writ petition is accordingly allowed. Interlocutory applications pending, if any, shall stand closed. No order as to costs. ------------------------------------------ A.RAJASHEKER REDDY,J DATE:17-07-2019 Note:
