THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION NO.3686 of 2022 ORDER:- This petition is filed under Section 438 of the Code of Criminal Procedure, 1973 (for short "Cr.P.C.") seeking pre-arrest bail to the petitioners, who are arrayed as Accused Nos.1 to 3, in the event of their arrest in connection with Crime No.88 of 2022 of Makthal Police Station of Narayanpet District, registered for the offences punishable under Sections 498-A, 307 of Indian Penal Code and Section 3 and 4 of Dowry Prohibition Act, 1961.

It is reported by the learned Counsel for the petitioners that, after filing of this petition, petitioners 2 and 3 were arrested by the police and accordingly, the petition against petitioners 2 and 3 is dismissed. 3.
The 1st petitioner/Accused No.1 is the husband of the de facto complainant. The de facto complainant filed
complaint stating that they were married on 8.12.2019 and in the process of demand for additional dowry of Rs.10 Lakhs, the 1st petitioner got enraged and pressed the neck of the de facto complainant with heavy force with an intention to kill her, however, the de facto complainant escaped and thereafter filed the present complaint. Since no injuries are received by the de facto complainant the case appears to be one of demand for additional dowry. The 1st petitioner being Scientist in NSTL, Viaksapatnam, custodial interrogation may not be required. Therefore, the relief of anticipatory bail can be granted to the 1st petitioner.

The Criminal Petition is, accordingly, allowed and the 1st petitioner/Accused No.1 is granted anticipatory bail subject to the following condition:
(1) The 1st petitioner/Accused No.1 is directed to surrender before the Station House Officer, Makthal Police Station, within ten days from the date of this order, and, on such surrender, the petitioner is are directed to be released on bail on
his executing a personal bond to the tune of Rs.25,000/- (Rupees twenty five thousand only) with two sureties to the like sum each to his satisfaction.
(2) The 1st petitioner/Accused No.1 shall abide by the other conditions stipulated in Section 438(2) Cr.P.C and co-operate with the Investigating Officer in investigating the case as and when required.
(3) The 1st petitioner shall appear before the concerned Police on 1st and 3rd Saturday of every month for a period of three months.
Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
