HON'BLE SRI JUSTICE C.PRAVEEN KUMAR CRIMINAL PETITION No.2196 of 2015 ORDER:

The petitioner, who is an accused in Crime No.36 of 2015 of Sangareddy Police Station, Medak District, filed this Criminal Petition under Section 438 Cr.P.C. seeking release in the event of his arrest in connection with the above case, registered for the offences punishable under Sections 468, 471 and 420 I.P.C. The case of the prosecution is that the Informant - Municipal Commissioner, Sangareddy, lodged a report on 12-02-2015 stating that pursuant to the verification of Municipal records made on the basis of representation of one, V.Anjaiah, they found that the Ownership Certificate vide No.A1/638/2014, dated 14-12-2014 was not issued from their office in favour of one, Md.Omar and more over the date on which it was issued was a Sunday. Hence, requested to take necessary action in the matter. Basing on these allegations, the above case came to be registered.

Heard the learned counsel for the petitioner and the learned Public Prosecutor for the Respondent-State.

The material on record would disclose that the Municipal Commissioner, Sangareddy lodged a report showing that the document which the petitioner sought to rely was a fake and fabricated document. The facts in issue disclose that by using the said certificate the petitioner claimed ownership over the property belonging to one, V.Anjaiah.

In view of the above and as the allegations made prima facie constitute the offences alleged, I am not inclined to grant anticipatory bail to the petitioner.

Criminal Petition is accordingly dismissed.
