ORDER
Challenging the inaction of the 2nd respondent in renewing the recognition of petitioner No.2 for classes I to V though the recognition for classes VI to X (TM/EM) is existing till 2020-21, the present writ petition is filed. It appears, there are disputes with regard to management of the institute between the petitioners and the 4th respondent and SROP No.429 of 2015 is pending before the I Additional District Judge, Khammam. Now, the petitioners filed O.S.No.59 of 2015 for perpetual injunction and the same is also pending. The recognition is not being renewed solely on the ground of disputes between the petitioners and the 4th respondent. But the school is being continued. In order to manage the affairs, one person has to be recognized as Correspondent by the competent authority.
Since substantial matter is pending with regard to rights of the petitioners and the 4th respondent vide SROP No.429 of 2015, liberty is given to the petitioners as well as the 4th respondent to file an appropriate application before the learned I Additional District Judge, Khammam, who in turn, shall pass orders pending disposal of SROP No.429 of 2015 for taking
action by the competent authority by recognizing a particular person as Correspondent for looking after the day-to-day affairs of the society under the provisions of the Andhra Pradesh Education Act. It is needless to observe that in view of urgent need of the 2nd petitioner, who is running the 1st petitioner school, the application filed by the parties shall be disposed of by the concerned Court, as expeditiously as possible, on its own merits, uninfluenced by the observations made by this Court, if any. No costs.
Miscellaneous petitions, if any, pending shall stand closed.
